1) Acceptance of these terms:
The customer herein known as the purchaser, agrees to the following terms of sale upon acceptance of a quote from Promotion Productions herein known as Promonz and or payment of a deposit to and or a request for goods or services from Promonz, the customer confirms they have read, understand, and accept these terms and conditions of sale.
2) Goods:
All goods remain the property of Promonz until paid for in full. If goods are on sold to a third party these goods remain the property of Promonz until all accounts relating to said goods are settled. Promonz reserves the right to uplift said goods without notice if the terms of sale are broken and to take any legal action to recover moneys owed.
3) Art and Design:
All ideas concepts and designs created by Promonz remain the property of Promonz until paid for in full and may not be copied or used in any form without the express permission of Promonz.
4) Free art and design, where applicable:
To receive free art and design the purchaser agrees that this service is only available on completion of the order and for the use of products purchased from promonz only, ( we do not produce free art for others to use) If you wish to use or alter your art you may purchase it from promonz, this will be calculated based on the time spent by our standard artwork charge, once you have paid for your art it then becomes your property not withstanding any other rights held by third parties.
If for any reason including cancellation of the order the job is not completed, any art, design, film or screen charges and any other charges relating to the order must be paid for in full. The customer agrees these charges may be deducted from a deposit or credit card where deemed necessary by Promonz.
4a) Screen Stencils:
The term Screens or Screen Stencils, relates to the labour cost of producing a screen stencil only, this being the photosensitive emulsion, the application, exposure and developing thereof to produce a stencil image. The Terms dose not refer to the physical screen, being the wood or aluminum frame stretched with silk. This frame and silk remain the property of Promonz.
5) Completion dates:
Completion dates are an estimate only, please contact us if you wish an exact delivery date.
5a) Delivery by Courier:
Delivery to the courier constitutes delivery to the customer, any claims for loss or damage must be made directly to the courier. Promonz will supply supporting documentation to this end.
6) Refunds and Returns of Promonz Products:
Promonz stand by there products and will replace any products that are not up to acceptable industry standards. These goods will be replaced with the same goods only e.g. color, size, style. The purchaser understands that Promonz dose not refund cash but is happy to replace the goods as above.
7) Cancellation of orders:
The purchaser may cancel an order up to the time of printing however the purchaser agrees to pay any charges relating to the job so far e.g. Art, (including free art as above) film, Screens, Embroidery, Set Ups or any other charges. There is a $ 25.00 cancellation fee not withstanding any other charges. This fee is to cover the cost of administration, for example, returning of garments to stock and processing of job order sheets and files in preparation for production. This can take a considerable amount of time. The purchaser agrees to allow Promonz to deduct this amount from any deposits.
8) Supplying your own garments for printing:
All prices are based on garments being “Prepared for print” please remove any packaging and sort into correct lots of design colour, size etc., As this can take as long as it dose to print the items any time spent removing packaging or sorting goods will be charged at our standard print rate.
8a) All Care:
While all care is taken, and we have many years experience contract printing, we cannot be held responsible for any damage to garments or financial loss due to any process or event while goods are in our care or during any decorating process or due to any other reason what so ever.
9) Collection of overdue payments:
By accepting these terms and conditions the purchaser agrees to be responsible for and to pay any costs relating to the recovery of moneys owing to Promonz by the Purchaser. This includes any collection or legal fees and any other costs that may arise from non payment by the Purchaser including any interest costs to Promonz.
